  3. In this tutorial we list the age of adulthood (majority) for each
  4. state, the ages for marriage with court approval, without court 
  5. approval but with parental approval, for minors, and if common 
  6. law marriages are recognized. Many states do not recognize 
  7. common law marriages, but, will recognize a common law marriage
  8. if the same is recognized in the state where entered into.
  9.  
  10. Let's get some terms defined. A common law marriage is a marriage
  11. "without the benefit of clergy." In other words, a marriage in
  12. which there is no formal ceremony. Although each state has its
  13. own rules, the basic requirements for a common law marriage to be
  14. recognized are:
  15.  
  16. 1. There must be verbal assent to the marriage (per verba
  17. preasenti in Latin) by mutual exchange of an agreement to marry
  18.  
  19. 2. There must be a public holding out of the persons as married
  20.  
  21. 3. There must be capacity (in other words, both persons need to
  22. be unmarried and of legal age)
  23.  
  24. The idea behind recognizing common law marriages was that in the
  25. good old days, folks just didn't have the ability to go and ride
  26. for a few days on a horse to get to the county seat for a
  27. license. That simply isn't a realistic scenario anymore. In fact,
  28. it is a nightmare when dealing with social security etc. to prove
  29. that you are married if you don't have a license! Nevertheless we
  30. document the present rules on the situation.
